Introduction

Please read these terms carefully before using the website/mobile application. By accessing or using services, you agree to be bound by these terms. If you do not agree, do not access or use the website/mobile application.

User Eligibility

Services are available only to persons/entities who can form legally binding agreements under applicable law in India.

Acceptance of Terms

Your first use of the website/mobile application confirms acceptance of these terms. You agree not to use services for unlawful or prohibited purposes.

Need for Registration

Users must register with true and correct information, including full name, firm/company name, address, mobile number, email ID, PAN, Aadhaar, GST and other details as required.

Terms of Use

  1. We will use reasonable efforts to correct errors/omissions once notified, but do not guarantee fault-free services.
  2. Service access may be interrupted, suspended, restricted or terminated at any time.
  3. We do not guarantee services are free from viruses or harmful components.
  4. Merchants must not undertake unauthorized cash collection/settlement and must maintain sufficient pre-load funds.
  5. We may modify/suspend/remove information/services without prior notice.
  6. We may block access/edit/remove materials that may violate these terms.
  7. Any breach may result in immediate revocation of license to use website/app.
  8. Commercial use for another business is prohibited unless explicitly permitted.

Prohibited Content / Conduct

You shall not upload/publish material that:

  • Infringes copyrights, patents, trademarks or proprietary rights.
  • Is defamatory, obscene, offensive, illegal or otherwise prohibited under Indian law.
  • Contains malware, harmful code, viruses, worms or trojans.
  • Involves fraud, harassment, stalking, spamming or unlawful activity.

IT Act, 2000 Compliance

Users must comply with Rule 3 and related provisions under IT Act, 2000, including restrictions on unlawful, harmful, misleading, infringing or security-threatening content.

Data Protection

Personal information supplied by users during use of website/mobile application is governed by our Privacy Policy.

Disclaimer

Information/products/services are provided on an "as is" basis without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

Limitation of Liability

To the maximum extent permitted by law, IkPay shall not be liable for indirect/incidental/consequential damages. Aggregate liability shall be limited to charges paid by you for the service giving rise to the claim.

Indemnification

Users/Merchants agree to indemnify and hold harmless IkPay, its directors, officers, employees and partners from claims, damages, penalties and expenses arising from breach of terms, applicable laws, security failures or third-party claims.

Intellectual Property Rights

All content including text, logos, graphics, designs, software and trademarks are protected by applicable IP laws. Unauthorized use/reproduction/distribution is prohibited.

Amendments

We may modify these terms at any time without prior notice. Revised terms take effect upon posting.

Termination

We may suspend or terminate access to website/mobile application or services at any time for violations, suspected fraud, unauthorized activity or other valid reasons.

Governing Law and Jurisdiction

These terms are governed by Indian law. Courts in Gujarat shall have exclusive jurisdiction.

Severability and Entire Agreement

If any provision is held invalid, remaining provisions remain effective. These terms constitute the entire agreement for website/mobile application use.
